1. Agreement to Terms

By accessing or using PDFSpark.app (“Service”, “we”, “us”, or “our”), you agree to be bound by these Terms and Conditions (“Terms”). If you disagree with any part of these Terms, you may not use our Service.

2. Service Description

PDFSpark provides browser-based PDF processing tools, including:

PDF Compression – Reduce file size while maintaining quality
PDF Merge – Combine multiple PDF files into one document
PDF Split – Extract specific pages or split into separate files
PDF Conversion – Convert documents and images to PDF format

What We Do:

Process files through secure, encrypted connections
Provide fast processing (typically 5-10 seconds)
Automatically delete all files within 60 minutes of upload
Accept payments via Stripe for completed operations

What We Don’t Do:

Store, access, or share your files beyond the 1-hour processing window
Require user accounts, passwords, or personal information
Track your usage, sell your data, or serve advertisements
Guarantee specific file size reductions or conversion quality
Provide file storage or backup services

3. No User Accounts Required

PDFSpark operates on a zero-registration model:

No user accounts are created or maintained
No passwords are stored
No personal information is collected beyond payment email receipts
Each transaction is independent and anonymous
You are responsible for downloading and saving processed files before they are automatically deleted

4. Payment Terms

4.1 Pricing

Cost: $0.99 USD per operation (one-time payment)
No Subscriptions: Each operation is charged independently
No Credits: Pay only when you process a file
No Hidden Fees: Price includes all processing costs

4.2 Payment Processing

All payments are processed securely through Stripe, Inc.
We do not store or have access to your credit card information
Stripe is PCI DSS Level 1 certified
Accepted payment methods: Credit cards, debit cards, Google Pay, and other Stripe-supported methods

4.3 Payment Authorization

By initiating payment:

You authorize us to charge $0.99 to your chosen payment method
You confirm you are authorized to use the payment method
You agree the charge is for a completed file processing operation
Payment is processed immediately upon confirmation

4.4 Non-Refundable with Exceptions

Standard Policy:
Payments are generally non-refundable once file processing is complete and the download is available.

Refund Eligibility:
You may request a full refund within 24 hours if:

Your file failed to process due to a technical error on our end
The processed file is corrupted or unusable due to our service
You were charged but did not receive a processed file

Refund Process:
Email rafal@oleksiakconsulting.com within 24 hours with:

Your payment receipt or transaction ID
Description of the technical issue
Original and processed files (if applicable)

We will respond within 48 hours and issue refunds to the original payment method within 5-10 business days.

No Refunds For:

User error (uploading wrong file, selecting wrong options)
File compatibility issues clearly stated in documentation
Changes of mind after successful processing
Files that process correctly but don’t meet subjective expectations

5. File Upload and Processing

5.1 File Requirements

Maximum File Size: 100 MB per file
Supported Formats: PDF (for compression, merge, split); additional formats for conversion (Word, Excel, PowerPoint, images)
Processing Time: Typically 5-10 seconds; larger files may take longer
Browser Requirements: Modern browsers with JavaScript enabled

5.2 File Ownership and Rights

You Retain Ownership: You maintain all intellectual property rights to files you upload
Processing License: By uploading, you grant us a temporary, limited license to process your file
License Termination: This license automatically terminates when your file is deleted (within 1 hour)
Your Responsibility: You must own rights to all files you upload or have permission to process them

5.3 Automatic File Deletion

Deletion Timeline: All uploaded and processed files are permanently deleted within 60 minutes of upload
No Recovery: Once deleted, files cannot be recovered by us or by you
No Exceptions: This policy applies to all files without exception
Your Responsibility: Download processed files immediately; we are not responsible for files you fail to download

5.4 File Security

Encryption: All files are encrypted with 256-bit AES encryption during upload, processing, and download
Secure Transfer: All connections use HTTPS/TLS encryption
No Access: We do not view, access, or analyze the content of your files
No Logs: File content is not logged or recorded

6. Prohibited Uses

You may not use PDFSpark to:

6.1 Illegal Activities

Upload or process files containing illegal content
Violate any local, national, or international laws
Infringe on intellectual property rights of others
Distribute copyrighted materials without authorization

6.2 Harmful Content

Upload files containing malware, viruses, or malicious code
Process files intended to harm, exploit, or abuse others
Upload child sexual abuse material (CSAM) or any content exploiting minors
Distribute spam, phishing materials, or fraudulent content

6.3 Service Abuse

Attempt to reverse engineer, hack, or compromise our service
Use automated tools to overwhelm our servers (DDoS attacks)
Circumvent payment systems or security measures
Attempt to access files uploaded by other users

6.4 Enforcement

We reserve the right to:

Refuse service to anyone for any reason
Report illegal activity to appropriate authorities
Terminate your access immediately without refund if you violate these Terms
Cooperate with law enforcement investigations

7. Privacy and Data Protection

7.1 GDPR Compliance

As a service operating in the European Union, we comply with the General Data Protection Regulation (GDPR):

Minimal Data Collection: We collect only payment email addresses for receipts
Right to Deletion: Files are automatically deleted within 1 hour
No Profiling: We do not track, profile, or analyze user behavior
Data Processing: File processing is the lawful basis for temporary data storage
Third Parties: Payment data is processed by Stripe according to their privacy policy

7.2 What We Collect

Payment Information: Email address for receipt delivery (processed by Stripe)
Technical Data: Anonymous server logs for security and error monitoring (no file content)
No Cookies: We do not use tracking cookies or analytics

7.3 What We Don’t Collect

Names, addresses, or personal information
File content or metadata
Browsing history or usage patterns
Marketing data or behavioral profiles

7.4 Data Sharing

We Do Not Share Data: Your files and information are never shared, sold, or disclosed to third parties
Exception: Legal obligations (court orders, law enforcement requests for illegal content)

8. Intellectual Property

8.1 Service Ownership

Our Property: PDFSpark’s code, design, trademarks, and branding are owned by Rafal Oleksiak Consulting
License to Use: We grant you a limited, non-exclusive, non-transferable license to use the Service for personal or business purposes
Restrictions: You may not copy, modify, distribute, or reverse engineer our Service

8.2 User Content

Your Property: You retain all rights to files you upload
No Claims: We make no ownership claims to your files
Responsibility: You are solely responsible for ensuring you have rights to process uploaded files

9. Disclaimers and Warranties

9.1 “As Is” Service

PDFSpark is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including but not limited to:

No Uptime Guarantee: Service availability is not guaranteed; downtime may occur for maintenance or technical issues
No Quality Guarantee: File compression rates, conversion quality, and processing results may vary
No Compatibility Guarantee: Some files may not be compatible with our processing tools
No Data Loss Protection: You are responsible for maintaining backups of original files

9.2 Third-Party Services

Stripe: Payment processing is handled by Stripe; we are not responsible for Stripe’s service availability or errors
Stirling PDF: File processing uses open-source software; processing quality depends on Stirling PDF capabilities
Internet Connection: Service requires a stable internet connection; we are not responsible for connectivity issues

9.3 No Professional Advice

Our Service is for file processing only
We do not provide legal, financial, or professional advice
Consult appropriate professionals for specific guidance

10. Limitation of Liability

10.1 Maximum Liability

To the fullest extent permitted by law, our total liability for any claims arising from your use of PDFSpark shall not exceed the amount you paid for the specific transaction in question (i.e., $0.99 USD).

10.2 Excluded Damages

We shall not be liable for:

Data Loss: Loss of files due to automatic deletion or technical failure
Business Losses: Lost profits, revenue, business opportunities, or contracts
Indirect Damages: Consequential, incidental, or punitive damages
Third-Party Claims: Claims arising from your violation of third-party rights
Force Majeure: Events beyond our reasonable control (natural disasters, cyberattacks, government actions)

10.3 User Responsibility

You are solely responsible for:

Backing up original files before processing
Verifying processed files meet your requirements
Downloading files before automatic deletion
Ensuring you have rights to process uploaded files

10.4 Indemnification

You agree to indemnify and hold harmless Rafal Oleksiak Consulting, its officers, employees, and contractors from any claims, damages, or expenses (including legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of third-party rights
Illegal or prohibited content you upload

11. Modifications to Service and Terms

11.1 Service Changes

We reserve the right to:

Modify, suspend, or discontinue any part of the Service at any time
Change pricing with 30 days’ notice
Add or remove features without prior notice
Perform maintenance causing temporary unavailability

11.2 Terms Changes

We may update these Terms at any time
Notice: Material changes will be posted on pdfspark.app with the updated “Last Updated” date
Your Acceptance: Continued use after changes constitutes acceptance of new Terms
Disagreement: If you disagree with changes, stop using the Service

11.3 Notification

Check this page regularly for updates
We may (but are not required to) notify users of major changes via email if we have your address

12. Termination

12.1 Termination by You

You may stop using the Service at any time without notice
No refunds for unused services (since we don’t offer subscriptions)

12.2 Termination by Us

We may suspend or terminate your access immediately if:

You violate these Terms
You engage in prohibited activities
Required by law or legal process
Protecting our systems from abuse or attack

12.3 Effect of Termination

Your right to use the Service immediately ceases
Any pending transactions will be completed or refunded at our discretion
Provisions regarding liability, indemnification, and dispute resolution survive termination

These Terms are governed by the laws of Poland, without regard to conflict of law principles.

13.3 Jurisdiction

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rafal Oleksiak Consulting regarding PDFSpark.

14.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

14.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

14.4 Assignment

You may not assign or transfer these Terms; we may assign our rights without restriction.

14.5 Language

These Terms are written in English. Translations may be provided for convenience, but the English version prevails in case of conflict.

16. Acknowledgment

By using PDFSpark, you acknowledge that:

You have read and understood these Terms
You agree to be bound by these Terms
You are at least 18 years old or have parental consent
You will use the Service in compliance with all applicable laws
You understand files are automatically deleted after 1 hour
You are responsible for downloading processed files before deletion
